 Who Is Responsible For Drivers Blocking Fire Lanes That Delay Emergency Responders ?

  Several local residents and members of the Valencia Street Residents Group 
discussed this question after yesterday's (Sat April 29, 2022) harassment and 
assault of James (The Volunteer Coordinator of the Valencia Street Safety 
Team) over the issue of blocking fire and bike lanes during Valencia Closed 
Street Events. 

   We discussed what if a Building or Business Owner or their Managers and 
Agents actually fostered, directed and encouraged any driver, including their 
employees, customers and delivery people to Park in Bike and Fire Lanes 
during Closed Street Events or at any time,  then who is responsible if a 
person gets hurt or dies because the Drivers are Blocking Access Lanes 
which cause a Delayed Emergency Response ?

   I don't know what a Judge would say if the Driver, Building or Business 
Owners or their agents encouraged or directed their Drivers to "go ahead 
and park out front in the Fire and Bike Lanes and ignore anyone who 
warns you not to park there.   Pay no attention to residents;  event or 
safety team volunteers if they try to warn you or get you to park at 
the curb."
  
  I would guess that perhaps the Driver(s), Building or Business Owners 
or their Managers,  Agents or Representatives would likely be deemed 
to be responsible because all were told to ignore laws restricting parking 
or blocking Fire and adjacent Bike Lanes to allow unfettered access to 
buildings by Emergency Responders, at all times.   Should harm or even 
death or damage to buildings result because their Drivers delayed any 
emergency response, it appears they would all be held responsible in 
any civil or criminal court.  

  If their Insurance Companies knew that Drivers were being directly, 
to violate the law and block these lanes,  I imagine the offenders rates 
would be increased or possibly lose their coverage because they are 
conspiring to break the law,  for their own personal or commercial 
gains.    

   This is exactly what we found out yesterday when a man claiming 
to be a "Senior Building Manager" of a restaurant in the 500 Block 
of Valencia Street, yesterday.    He gave the residents who witnessed 
his harassment and assault saw and heard this man threaten anyone 
who tries to keep the Fire Lane and Bike Lane clear, when "his Drivers" 
try to park alongside the Parklet Dining Area out front, illegally and 
hazardously blocking the eminent right-of-way of our neighborhood's 
emergency responders.

   What Do You Think ?    
 
Is It Okay With You If Drivers Are Being Told By Building & Business 
Owners To Block Fire and Bike Lanes on Valencia Street, especially 
during Closed Street Events ?
 
Who Pays The Price If A Person Gets Hurt or Dies If Emergency 
Responders Are Delayed By Drivers, Told To Park In Fire and 
Bike Lanes By Building/Business Owners or Managers ?
